Issues arising from the elections and negotiations

ORAL ARGUMENTS
Case EL 01-12/01 Petition to Contest Exclusionary Designation filed by MCEA against Bowie State . The Executive Director made a ruling on this case, that Mr. Jakarta Hall be included in the Sworn Police Unit, based on the materials provided. The Institution is appealing that decision.

Format: each side will have up to 30 minutes to present oral argument and witnesses for whom subpoenas have been issued and have been duly notified of this limitation.

Board Certification of resolved elections as previously certified by the Executive Director and effective as of that date.

None have been held since August 29.

The August 29 final adoption of the following regulations were published September 20, 2002 and will take effect September 30, 2002.

The August 29 regulations adopted for publication were published September 20, initiating a 45-day Notice and Comment period in which interested parties may offer comments and opinions in writing as per the Administrative Procedures Act. The following were included:

Withdrawal from Election (proposed part of §14.30.05)
Decertification Regulation
Notice of Impasse
Hearings, OAH turn-around time (proposed part of §14.30.11.23(A))

Set regular meeting calendar for the next 12 months

Following the Board’s policy of a year ago, regular meetings will be scheduled for the last Thursday of each month except when that date falls on a traditional holiday or other conflict date.

ACTION: the Board approves the following schedule of regular meetings for the next year:
Nov. 21, 2002 June 26, 2003
Dec. 21, 2002 July – no meeting
Jan. 30, 2003 Aug. 28, 2003
Feb. 27, 2003 Sept. 25, 2003
Mar. 27, 2003 Oct. 30, 2003
Apr. 24, 2003 Nov. 20, 2003
May 29, 2003 Dec. 18, 2003

Meetings will normally begin at 9:00 a.m. at the Maryland Higher Education Commission board room, 839 Bestgate Road , Annapolis .

Individuals may sign up to present comment on Board business, except matters filed as cases, and may present comments for up to 3 minutes.
