ORAL ARGUMENTS or HEARING

Note: These regulations have been proposed prior to this meeting, however, it was not clear that the Board had officially voted to issue them as proposed regulations through the State Documents office.

**A timely appeal was filed in this case on October 22, 2002 , and a hearing or oral argument may be held. The parties may have a conflict with the timing of the hearing due to afternoon schedules, and may wish to continue until the November 21 Board meeting.

Case EL 01-16/01 Petition to Contest Exclusionary Designation filed by MCEA against Salisbury University. The Executive Director made a ruling on this case that Officers Brown, Nicholas, and Webb would be included in the Sworn Police Unit at Salisbury University .

Format: each side will have up to 45 minutes to present oral argument (and/or witness testimony, if they have chosen to have a full hearing).

Board Certification of resolved elections as previously certified by the Executive Director and effective as of that date.

None have been held since August 29.

Regulations
The August 29 regulations adopted for publication were published September 20, initiating a 45-day Notice and Comment period in which interested parties may offer comments and opinions in writing as per the Administrative Procedures Act. The following were included:

Hearings, OAH turn-around time (proposed part of §14.30.11.23(A))

All comments on these regulations are due to the SHELRB office on November 4, 2002 .

Consideration of proposed amendments and new additions to regulations, as introduced at previous meetings:
